Welcome to Kokoro Skincare - A specialist Japanese beauty retailer in the Netherlands.

The following terms and conditions outline the rules and guidelines governing your use of our website and your interactions with us. Please read these Terms of Service carefully before accessing or using our website. By accessing and using our website, you agree to comply with these terms. If you do not agree with any part of these terms, please refrain from using our website. 

By agreeing to these Terms of  Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

2. DEFINITIONS 

  • ‘ Seller/we/our/us/Kokoro Skincare’ refers to Kokoro Beauty B.V. located at Weena zuid 120, 3012NC, Rotterdam. This company is registered in Netherlands with a company registration number of 93019580. 
  • ‘Online store/Website’ Pertains to the method by which customers can browse and purchase products from Kokoro Skincare through our website, www.kokoroskincare.nl. Please note that this is the only official and registered website for Kokoro Skincare. 
  • ‘Customers’ refers to the person who is the intended recipient of this document 
  • ‘International customer’ pertains to any customer outside the Netherlands. 
  • ‘Order’ refers to the process of submitting a purchase request for products on www.kokoroskincare.nl by the customer.

4. WEBSITE ACCESS 

Our online services are located solely within the Netherlands. This means that any purchase you make through our website will be governed by laws of Netherlands, regardless of where you live. 

Our website is designed for persons residing in the Netherlands. Hence all products are listed and paid for in Euros (€/EUR).  

Please be aware that our site may not always be available. We or Shopify (our website hosting platform reserve the right to suspend, withdraw, discontinue, or change any part of our website without notice to any person or specific geographical area at any time. 

It is not permissible to make any modifications, deletions, distributions, or postings on our website for any reason. 

 

5. ACCOUNT REGISTRATION AND PERSONAL INFORMATION 

To utilize particular features and services offered on our website, you may be required or prompted to create an account. It is your responsibility to ensure the accuracy of any personal information you provide us, and to keep any account information shared with Kokoro Skincare confidential - this includes safeguarding your log-in details such as passwords or prompts. 

All activities carried out under your account are your responsibility. Information required for an account may include personal information such as but not limited to your name, age group, mobile number, and email address. 

We reserve the right to remove your account at any time or may change and update account registration requirements at our discretion without prior notice. You may not impersonate someone or use a fake email address when submitting information. This can mislead us about where the information came from. 

If any claims arise from your submission or any third party’s claims to the information, you agree to take responsibility and protect us from any harm. 

For information regarding account data and personal information storage, please refer to our “Privacy policy”. As stated in the policy, if at any point you wish to have your information removed or have questions about your data don’t hesitate to get in touch with us at info@kokoroskincare.nl.  

6. ACCURACY OF INFORMATION 

This website and its content may contain errors or omissions; we cannot guarantee otherwise. 

At Kokoro Skincare, we do our best to keep our website’s content and product information accurate and current. However, manufacturers/brands/suppliers may change product descriptions, ingredients, and packaging designs without notifying us. As a retailer for all the brands featured on our website, we are not responsible for manufacturing any of the products listed. As such, Kokoro Skincare cannot guarantee the accuracy of ingredient information or manufacturer-indicated product claims on packaging and cannot be liable for any adverse reactions caused by the products we sell. 

Our product descriptions are provided for informational purposes only and should not be considered advice that purchases should rely on. 

It is essential to carefully read product labels and consult with the manufacturer if you have any concerns about allergies or sensitivities. We have the right to update descriptions, inaccuracies, or omissions without notifying you beforehand.  

A detailed “PRODUCT INFORMATION DISCLAIMER” is linked on all product pages in the ingredient and how to use section, and we strongly advise reading and understanding this before completing your purchase. 

 

7. PRODUCT PRICES AND AVAILABILITY 

We reserve the right to amend our products’ prices, discontinue or remove listings without prior notice. Kokoro Skincare may also restrict or limit purchase quantities for specific items at any point. Including after an order has been placed. 

At Kokoro Skincare, we take pride in our internal policy of not offering pre-order listing on our website. We only list products that are physically present at our warehouse and have been counted and stored by our packing team. Additionally, we do not advertise products that are still in transit. However our product selection is still subject to availability based on other factors (such as individual item damage, or has been made subject to a purchase limit, we will notify you and offer a suitable alternative or refund. The item may be removed and refunded if we cannot contact you. Alternatively, the order may be cancelled and in both circumstances, a notification will be sent to the email address you provided.  

8. ORDERING AND PAYMENTS 

By placing an order on our website, you must ensure that the information you provide is accurate, complete and current. 

All payments are securely processed through designated payment gateways. When making a purchase, you must provide valid payment details and confirm that the billing information belongs to you. Credit card information is always encrypted during transfer over networks; however, please note as with all internet transactions we cannot guarantee the security of personal data. 

After receiving your order, we will provide you with a confirmation email and order number. If we cannot fulfil your order, we will contact you via your provided email to inform you. Once your order has been packed and is ready for dispatch, we will send a shipping confirmation email. This shipping confirmation email will signify the formation of a legally binding contract between us. 

We reserve the right to refuse or cancel any order at our discretion. If your order is cancelled, full notice and refund information will be provided in writing to your provided email address. 

 

9. SALE, OFFERS & PROMOTIONS 

Discount codes may be subject to individual Terms and Conditions. Which will be indicated to you at the time of issue. All discount codes are non transferable, cannot be combined with other promotions, offers or already discounted products, and may not be used toward purchasing gift cards.  

Discounts will not be granted, may be revoked, and may not be redeemed for a future purchase if the initial transaction is cancelled or item(s) are returned. The discount may be suspended or terminated at any time and may be subject to product restriction or exclusions. 

All sale and promotional items have been made available for purchase at their original, higher price for a minimum of 28 days before being sold at the stated reduced price. There is only one exception to this rule: when we have a “launching sale” for a new brand. In such cases, we will inform you of the lower promotional and the higher after-sale prices. After the promotion period, all items will be sold at the ‘full price’ originally stated for a minimum of 28 days. 

  

10. SHIPPING AND DELIVERY 

Please refer to our “SHIPPING POLICY” for specific shipping times and costing information. 

 

KOKORO SKINCARE fulfil and ship all orders directly from our Rotterdam warehouse. We aim to deliver products worldwide (the full location listed is in the delivery policy) and across the Netherlands within the estimated timeframe stated in our Delivery Policy. 

Any delivery timescales we provide are estimates only, and we are not responsible for delivery delays outside our control. 

 

The prices displayed on our website include VAT, and the total cost of your order will be confirmed at checkout before you proceed to payment. However, if your delivery is being shipped outside of the Netherlands, please be aware that upon arrival in your local country, local laws may require you to pay additional taxes, feed or levies and import duty or formal customs entry in order to receive your parcel. 

Please note that as the buyer, you are solely responsible for any of these additional charges (if applicable), and KOKORO SKINCARE cannot be held responsible. 

 

11. CANCELATIONS, RETURNS AND REFUNDS. 

Sometimes you change your mind, or a situation arises surrounding delivery- we understand and respect that. If you wish to cancel your order for any reason within the relevant period of 14 days, make amendments, or have any questions about your order, please complete our “CONTACT FORM” at your earliest convenience. 

Once the order has been submitted, we cannot guarantee that Kokoro Skincare can complete any desired changes (including cancellation) before dispatch due to certain packing and fulfilment processes within our warehouse. If you reserve the right to cancel your contract after the parcel has been shipped to you, please ensure the items are returned to us “as new” in their original, unopened state. 

 

The Consumer Rights Act 2015 outlines your rights as a customer when purchasing products from us and states that goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your Products, your legal rights entitle you to the following: 

 

  • a) Up to thirty days: If your good are faulty, you are entitled to an immediate refund. In the context of our shop, this usually relates to things like damaged pumps, broken makeup pans etc – of which we will issue an immediate replacement or refund upon notification via our customer service email info@kokoroskincare.nl . You may be asked to provide supplementary photos fo the damage/fault. Please note negative skincare experiences such as reactions relation to incorrect usage or personal skin condition at the time of use may not be considered “faulty goods”. 
  • b) Up to six months: if your good cannot be repaired or replaced, then you are entitled to a full refund in most cases. 
  • c) After six months (depending on the specific product). You may be eligible for a partial refund if your goods do not last a reasonable amount of time. 

 

As a consumer, you must follow our “RETURN POLICY”, which contains more specific information about eligibility, the process, and requirements for returning products and seeking refunds. Please read and understand this policy before returning items or requesting a refund, ‘Your legal rights remain unaffected by your right to return and refund or any other provisions in these terms and conditions. 

 

12. INTELECTUAL PROPERTY 

On our site, you will encounter logos, trademarks, and service marks that belong to Kokoro Skincare, our brands/vendors, and/or suppliers. These marks are protected by trademark laws in the Netherlands and internationally. Please also note copy on this website, including but not limited to product descriptions, brand descriptions, graphics and blogs are also the intellectual property of Kokoro Skincare and are protected by applicable copyright and trademark laws. 

 

By accessing our website, you shall respect these copyright and license agreements. 

Any unauthorized use of our website, its contents, or our intellectual property is strictly prohibited unless permission is granted for personal, non-commercial use from us or our brands/suppliers. Kokoro Skincare cannot be held responsible or liable for any third-party or customer misuse of copyrighted materials displayed on this site. 

 

13. PROHIBITED ACTIVITIES 

Although we strive to monitor our website regularly, we cannot guarantee its security or freedom from bugs and internet viruses. By browsing our website, you assume responsibility for ensuring the safety of your own devices. We strongly advise using personal virus protection software on all devices that access our website. 

 

You agree not to engage in any conduct that could harm our website, interfere with it proper functioning, or infringe on the rights of others. This includes but is not limited to transmitting viruses, attempting unauthorized access, or engaging in illegal activities. Any such activity will be reported to Dutch law enforcement.

Kokoro Skincare may feature external links for customer convenience, including specific brand-posted content or products and services from third-party sources. If you click on any third-party links provided on our site, you will be redirected to websites that we are not affiliated with. We do not examine or evaluate the content or accuracy of these third-party materials, and we cannot guarantee their quality or safety. Therefore, we will not be held liable or responsible for any harm or damages that may result from your purchase or use of any goods, services, resources, content or other transactions made through any third-party websites. 

 

Before engaging in any transaction, it is important that you carefully review the third party's policies and practices. If you have any complaints, claims, concerns, or questions regarding third-party products, please contact the third party directly. 

 

15. REVIEWS 

As a transparent and education-centered company, we always welcome product and service reviews on our website and third- party review platforms (such as Google and Trustpilot). 

 

When using Kokoro Skincare's product review function on our website, you must ensure that any content you submit, including written reviews and photo uploads, is accurate and doesn't violate laws or offend others. This includes refraining from posting abusive, threatening, harassing, defamatory, ageist, sexist or racist content. By submitting any material, you confirm that you own or have the necessary rights to it and indemnify us against any breach of this warranty. We will also remove reviews that promote, mention, or are written by any persons with assumed links to competitor businesses. 

 

Subject to our PRIVACY POLICY, any material you upload to our site will be considered non-confidential and non-proprietary. We may use, copy, distribute, and disclose such material to third parties for any purpose. You waive your right to be identified as the author by uploading content. 

 

We may use the name you provided in connection with your content and disclose your identity to any third party claiming a violation of their intellectual property rights or right to privacy. In this event, we will do our best to inform you via your email address. 

 

We are not responsible for the content or accuracy of materials you or other users posted. We can proudly say that all reviews (including any reviews that could be considered negative with 1 and 2-star ratings) will be posted to the site unless we find material that violates the content standards mentioned above, in this case, we will act our right to remove it without notice.
